These Terms & Conditions apply to purchases made through the Studio McKinney website, www.studiomckinney.co.uk.
Please read these Terms & Conditions carefully before placing an order. By placing an order through the website, you agree to these Terms & Conditions.
Studio McKinney is the trading name of Johanna McKinney.

Throughout these Terms & Conditions, "Studio McKinney", "I", "me" and "my" refer to Studio McKinney, and "you" and "your" refer to the customer.
1. About Studio McKinney
Studio McKinney is an independent British art and design business creating original artwork, illustrations, prints, stationery and other countryside-inspired products.
Some products are designed and produced in collaboration with independent UK suppliers and manufacturers.
2. Ordering
When you place an order through the Studio McKinney website, you are making an offer to purchase the products in your basket.
Once your order has been received, you will receive an order confirmation by email confirming the details of your purchase.
Your order is accepted and a contract is formed between you and Studio McKinney when I confirm that your order has been accepted and is being processed.
I reserve the right to decline or cancel an order where there is a genuine reason to do so, including where:

There has been an obvious pricing or product description error

Payment has not been successfully authorised

I reasonably suspect fraudulent or unauthorised activity
If I need to cancel an order after payment has been taken, you will receive a full refund of the amount paid.
3. Payment
Payment must be made in full at the time of ordering unless an alternative payment arrangement has been agreed with you in writing.
The payment methods available will be displayed at checkout.
Payments are processed securely through the payment providers available through the Studio McKinney website.
Studio McKinney does not have access to or store your full payment card details.
For commissioned or bespoke artwork, a deposit may be required to secure your booking. The specific payment terms for commissions will be explained before your commission is confirmed.
4. Pricing
All prices displayed on the Studio McKinney website are in Pounds Sterling (£).
Delivery charges are shown separately and will be displayed before you complete your purchase.
Studio McKinney reserves the right to change prices at any time. Any price change will not affect an order that has already been accepted.
Every effort is made to ensure that prices displayed on the website are accurate.
If an obvious pricing error occurs and you have placed an order at an incorrect price, I will contact you before processing the order. You will have the option to confirm the order at the correct price or receive a full refund.
5. Product descriptions and images
I make every reasonable effort to ensure that product descriptions, dimensions, colours and photographs on the website are accurate.
However, colours may appear slightly different depending on your device, screen settings and lighting conditions.
Where products are handmade, printed or produced using natural materials, there may be minor variations between individual items.
Such variations will not normally be considered defects where they are consistent with the nature of the product.
If an item is materially different from its description, faulty or does not conform to the contract, your statutory consumer rights apply.
6. Product availability
Products are subject to availability.
Some Studio McKinney products are produced in limited quantities and may sell out.
Where a product is listed as unavailable or out of stock, you may contact me to ask whether it is expected to be restocked.
If you place an order for an item that subsequently becomes unavailable and I am unable to fulfil your order, I will contact you and arrange an appropriate refund.
For made-to-order and commissioned artwork, availability is subject to Studio McKinney's current production schedule.
7. Intellectual property and copyright
All artwork, illustrations, designs, photographs, logos, branding, written content and other creative material displayed on the Studio McKinney website are owned by Studio McKinney or used with permission.
All intellectual property rights are reserved.
You may not reproduce, copy, modify, distribute, sell, publish or commercially exploit any Studio McKinney artwork, illustration, design, photograph, product design or other creative content without prior written permission.
Purchasing an original artwork, print or commissioned piece does not transfer copyright or intellectual property rights to you.
Copyright remains with Studio McKinney unless a separate written agreement states otherwise.
This means, for example, that purchasing a commissioned illustration does not automatically give you the right to reproduce it commercially, turn it into products or use it for branding or promotional purposes.
Personal, non-commercial display of artwork that you have purchased is permitted.
8. Use of commissioned artwork
Unless otherwise agreed in writing, Studio McKinney retains the copyright and intellectual property rights in commissioned artwork.
I may use images of completed commissioned artwork for my own portfolio, website, social media, marketing, exhibitions and promotional purposes.
If your commission contains personal or sensitive information, or you have a particular reason why you do not want the finished artwork shared publicly, please discuss this with me before commissioning.
Any agreed restrictions on use will be confirmed in writing.
9. Bespoke and commissioned artwork
Studio McKinney accepts commissions for bespoke illustrations and Fine Art Portraits.
Before work begins, the agreed artwork, size, price, timescale and payment arrangements will be confirmed with you.
A deposit may be required to secure your commission date.
Because bespoke artwork is created specifically for you, the finished piece may not be identical to a photograph or reference image. Artistic interpretation is an inherent part of the commissioned process.
For portrait commissions, reference photographs supplied by the customer should be of sufficient quality and resolution for the artwork to be created accurately. If you intend to send reference photos taken by a professional, you must obtain permission from the copyright owner for their image to be used in this way.
Studio McKinney reserves the right to decline a commission where the supplied reference material is unsuitable or where the requested subject matter is not appropriate for the business.
Commission amendments
Reasonable amendments may be discussed during the agreed process.
Significant changes requested after work has commenced, particularly where they require substantial additional work or effectively require the artwork to be recreated, may incur an additional charge.
Any additional charge will be agreed with you before the additional work is undertaken.
Commission approval
Where applicable, you may be shown progress images or a preview of the artwork before completion.
Once the agreed artwork has been approved or completed in accordance with the commission, further changes may incur an additional charge.
Separate Commission Terms & Conditions may apply to individual commissions.
10. Cancellations
Standard products
For eligible products purchased online, you have statutory cancellation rights under UK consumer law.
In general, you have 14 days from the day after you receive your goods to notify Studio McKinney that you wish to cancel your purchase, followed by a further 14 days to return the goods.
Further information is provided in the Returns & Refunds Policy.
Personalised and bespoke products
The statutory cooling-off right generally does not apply to goods made to your specifications or clearly personalised.
This includes bespoke illustrations, personalised artwork and Fine Art Portrait commissions.
Once work has commenced on a bespoke commission, cancellation may therefore be subject to the specific commission terms agreed with you.
This does not affect your statutory rights where a bespoke item is faulty, not as described or otherwise does not conform to the contract.
11. Returns and refunds
Returns and refunds are handled in accordance with the Studio McKinney Returns & Refunds Policy.
Nothing in these Terms & Conditions removes or restricts your statutory rights under UK consumer law.
If you receive an item that is faulty, damaged, incorrect or not as described, please contact Studio McKinney as soon as possible so that the issue can be investigated and resolved.
12. Delivery
Delivery options, costs and estimated delivery times are explained in the Shipping & Delivery Policy.
Studio McKinney aims to dispatch orders within the timeframe stated on the website.
Delivery times are estimates rather than guaranteed delivery dates unless a specific guaranteed service has been purchased and confirmed.
Once an order has been dispatched, delivery is carried out by the relevant postal or courier service.
If your order is delayed, lost or arrives damaged, please contact Studio McKinney so that I can investigate and assist you.
Your statutory rights regarding delivery are not affected by these Terms & Conditions.
13. International orders
Where international delivery is offered, delivery charges and available destinations will be displayed at checkout.
Customers ordering from outside the UK may be responsible for customs duties, import taxes and other charges imposed by the destination country.
These charges are outside Studio McKinney's control and are the responsibility of the customer unless otherwise stated.
14. Website content
I make reasonable efforts to keep the Studio McKinney website accurate and up to date.
However, I cannot guarantee that the website will always be free from errors, omissions or temporary technical problems.
I reserve the right to update product information, availability and website content when necessary.
Nothing on the website affects your statutory consumer rights.
15. Limitation of liability
Studio McKinney will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside my reasonable control.
This may include events such as postal or courier disruption, severe weather, technical failures or other circumstances beyond my reasonable control.
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
16. Events outside my control
If circumstances outside Studio McKinney's reasonable control prevent or delay an order from being fulfilled, I will contact you as soon as reasonably possible and take reasonable steps to minimise the impact.
Such circumstances may include natural disasters, severe weather, industrial action, postal or courier disruption, supplier problems, power or internet failures, or other events beyond my reasonable control.
Where an extended delay occurs, I will work with you to find an appropriate solution.
17. Governing law
These Terms & Conditions and any contract between you and Studio McKinney are governed by the laws of England and Wales.
If you are a consumer living in another part of the UK, you will also retain any mandatory rights and protections provided to you under the law applicable to you.
Any disputes will be subject to the jurisdiction of the courts of England and Wales, unless applicable consumer law provides otherwise.
18. Changes to these Terms & Conditions
Studio McKinney may update these Terms & Conditions from time to time.
The version published on this page at the time you place your order will apply to that order.
The date at the top of this page will be updated whenever these Terms & Conditions are amended.

Your statutory rights

Where these Terms & Conditions conflict with your statutory rights, your statutory rights will take precedence.
