These Terms of Service (“Terms”) govern your use of the Studio McKinney website and the purchase of any products or services from us.
Studio McKinney is operated by Johanna McKinney trading as Studio McKinney (“we”, “us”, “our”).
By using this website or placing an order, you agree to be bound by these Terms. If you do not agree, you must not use the website.
Nothing in these Terms affects your statutory rights under UK law.

All artwork is created using professional materials and described as accurately as possible.

We reserve the right to amend product descriptions at any time.
3. Orders and Contract Formation
When you place an order, you are making an offer to purchase.
A contract is formed only when we confirm acceptance of your order by email.
We reserve the right to refuse or cancel any order before acceptance. If payment has been taken and we cancel the order, a full refund will be issued.
4. Prices and Payment
All prices are listed in GBP (£).
Unless otherwise stated, prices do not include:

Full payment is required at checkout for:

Small illustrations

A4 illustrations
For commissioned fine art portraits, payment terms will be agreed in writing at the time of booking.
We reserve the right to change prices at any time, but changes will not affect confirmed orders.
5. Custom and Commissioned Work
Custom illustrations and commissioned portraits are made to order.
Once work has commenced, orders for personalised or custom artwork cannot be cancelled except as required under UK consumer law.
By submitting reference photographs, you confirm that:

You own the images or have permission to use them

You grant us permission to use them solely for creating your artwork
We retain copyright in all artwork created unless otherwise agreed in writing.
We may display commissioned work for portfolio or promotional purposes unless you request confidentiality in writing at the time of booking.
6. Shipping and Delivery
Delivery timeframes are estimates only.
Risk in the goods passes to you when the goods are delivered to the address you provided.
If goods arrive damaged, you must notify us within 48 hours and provide photographic evidence of:

The shipping label
Nothing in this section affects your statutory rights.
7. International Orders
International customers are responsible for:

Any local handling charges
We are not responsible for delays caused by customs processing.
8. Consumer Rights
If you are a UK consumer, you have statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.
If goods are faulty, not as described, or not fit for purpose, you may be entitled to repair, replacement or refund.
For non-custom goods purchased online, you may have the right to cancel within 14 days of delivery. Full details are provided in our Refund and Returns Policy.
Personalised or bespoke goods are exempt from cancellation once production has begun.
9. Intellectual Property
All artwork, images, text, branding, and website content are owned by Johanna McKinney trading as Studio McKinney and are protected by UK and international copyright laws.

Without prior written permission.
Purchase of artwork does not transfer copyright.
10. Website Use
You agree not to use this website:

We reserve the right to suspend access for misuse.
11. Limitation of Liability
Nothing in these Terms limits or excludes our liability for:

Our website is hosted by Shopify, which processes certain data in order to operate the store.

We may suspend or terminate website access if these Terms are breached.
Any provisions which by their nature should survive termination shall continue in effect.

15. Governing Law
These Terms are governed by the laws of England and Wales.
The courts of England and Wales shall have non-exclusive jurisdiction.
